The OWC Mercury Elite-AL Pro Qx2 Enterprise Solution employs Enterprise level hard drives. Enterprise level drives undergo greater quality control at the factory and are engineered to tighter specifications so they can better handle 24/7 use. In addition, to keep the integrity of the RAID, we guarantee we will replace any problematic drive(s) with the same manufacturer. If we are unable to send the same model, we will replace all the drives with equivalent or better components.
By using Enterprise drives and offering the following enhanced warranty coverage, the OWC Mercury Elite-AL Pro Qx2 Enterprise Solution not only provides the maximum in flexibility and performance, but also the maximum in dependability.
While the highest quality components are used, failures, however unlikely, can occur. In those rare instances, our warranty will help get you back up and running as quickly as possible. For 5 years, we cover case and drive failure due to manufacturer defect (OWC is not responsible for drive data*). If a component in the case such as the fan were to malfunction, we would replace it. If one or more of the drives were to fail, we would replace them. Misuse or accidental damage is not covered by the OWC warranty.
Please read the manual carefully before using and feel free to contact our technical support if you have any questions. All repairs or replacements will use same or similar components equal to or better than the originals.
Once the first three years have elapsed, parts are covered, but labor will be a $45 minimum charge and $90 an hour thereafter. Only actual bench time is counted and final cost is dependent upon the situation. You will be provided a good faith estimate on final cost after the $45 charge.
If, in the first year, you have any product failure, we will overnight** advance ship you the proper replacement components. This will help you get back up and running by the next business day, excluding weekends and national holidays. If you need it faster than that, please call one of our representatives for pricing and information on same day shipping, Monday through Friday, not including national shipping holidays. Advance ships require a credit card for authorization and have additional terms.
If, at any time during the first 3 years, you experience a drive problem and need the information off the drive, you can send it to us for Level 1 recovery services. This means we will use various software programs in an attempt to extract the data. If we are successful, we will move the data to a new drive and send it back to you. Depending upon the situation and the amount of data involved, it could take up to a week for this process. Please note that we do not offer Level 1 recovery services on a mirrored RAID unless it is the result of interface board or bridge failure.
If we are unable to recover the data, you will have three options. First, if the data exists in other locations or is not mission critical, we can simply send you a replacement drive. Second, if it is necessary to retrieve the data, we can send it to a certified drive recovery center at your request. We do not cover the cost of the recovery or the shipping to the data recovery center, but can facilitate by providing a report on the results of our efforts. Third, we can send the drive back to you and you can then send it to the data recovery center of your choice. Please keep in mind that if the recovery center is not certified by the drive's manufacturer, you will not be able to get a replacement hard drive.
Return issuance is based upon phone diagnosis by an OWC tech support specialist. OWC reserves the right to repair, replace or upgrade to equivalent or better components for the duration of the warranty.
This warranty is expressly subject to the website Terms & Conditions ("Terms") & Terms of Sale located at www.macsales.com/tos, which are hereby incorporated herein and made a part hereof by this reference.
*OTHER WORLD COMPUTING IS NOT RESPONSIBLE FOR THE LOSS, CORRUPTION OR DESTRUCTION OF DATA WHILE USING ANY STORAGE PRODUCT PURCHASED FROM OTHER WORLD COMPUTING. OTHER WORLD COMPUTING WILL NOT BE HELD LIABLE IN ANY MANNER FOR THE RECOVERY OR RESTORATION OF ANY DATA LOST. TO MAXIMIZE YOUR DATA PROTECTION, OWC RECOMMENDS THAT YOU KEEP AN ADDITIONAL COPY OF YOUR DATA IN A COMPLETELY DIFFERENT LOCATION.
Other World Computing sells a wide variety of products from multiple manufacturers and cannot control all aspects of manufacturing, delivery or use. As a result, OWC is not responsible for special, incidental, or consequential damages including but not limited to, lost profits, downtime, technician fees, goodwill, damage to or replacement of equipment and property, and any costs of recovering, reprogramming, or reproducing any program or data stored in or used with any product purchased from Other World Computing. Additionally, OWC is not responsible for any problem that is caused by (a) commercial use; accident; abuse; neglect; shock; electrostatic discharge; heat or humidity beyond product specifications; improper installation; operation; maintenance or modification; or (b) any misuse contrary to the instructions in the user manual; or (c) loss passwords; or (d) malfunctions caused by other equipment.
This Limited Warranty applies only to the OWC/NewerTechnology. The Limited Warranty does not apply to any other Other World Computing hardware products or any software, even if packaged or sold with Other World Computing hardware. Manufacturers, suppliers, or publishers, other than Axiotron and Other World Computing, may provide their own warranties to the end user purchaser, but Other World Computing, in so far as permitted by law, provides their products "as is". Software included with the Modbook is not covered under this Limited Warranty. Refer to the licensing agreement accompanying the software for details of your rights with respect to its use.
Other World Computing does not warrant that the operation of the product will be uninterrupted or error-free. Other World Computing is not responsible for damage arising from failure to follow instructions relating to the product's use.
This warranty does not apply: (a) to damage caused by use with non-Other World Computing products; (b) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (c) to damage caused by operating the product outside the permitted or intended uses described by Other World Computing; (d) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Other World Computing or an Other World Computing Authorized Service Provider; (e) to a product or part that has been modified to significantly alter functionality or capability without the written permission of Other World Computing; (f) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship; or (g) if any Other World Computing serial number has been removed or defaced.
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. AS PERMITTED BY APPLICABLE LAW, OTHER WORLD COMPUTING SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF OTHER WORLD COMPUTING CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS WARRANTY AND TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY OTHER WORLD COMPUTING IN ITS SOLE DISCRETION. No Other World Computing reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.

THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. OTHER WORLD COMPUTING DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF THE PROGRAMS OR DATA.
