Deposits and Service Fees

The iPad 2 Repair program requires a non-refundable diagnostic service be performed prior to any iPad 2 repair work. OWC will estimate the cost of the repair(s) based on the non-refundable, non-invasive diagnostic service and obtain permission before proceeding with any repairs. Once the approved repair work has begun, it is no longer possible to receive the iPad 2 back in the condition it was sent in. If the approved repair service is canceled after it was started, OWC will only charge for the materials and labor used to that point. Since the initial diagnostic service was not invasive, it is possible additional problems will be found during the service process. OWC will not proceed with any repairs that are over the amount quoted in the estimate until the additional charges are approved. Should the additional repairs be rejected at that point and it is not possible to make the iPad functional without them, OWC will only charge for the materials and labor used to that point and will return the iPad in the condition it was in when the work was stopped. The iPad will remain inoperable.

Completion Date

OWC will strive to complete all work within the quoted 48-hour window, but there could be extenuating circumstance that would result in more time needed for the repair. Should OWC be unable to ship an iPad 2 back within the 48 hour period, a contact will be made explaining that there is a the delay and providing the updated time estimate. Weekends and national holidays are excluded from all quoted time frames.

Repairs and Replacements

OWC will repair all defects detected unless otherwise instructed during the consult. During the service, OWC may use new parts or parts equivalent to new in performance and reliability. OWC will retain as its property, or properly dispose of, any replaced parts exchanged under the service. At its discretion, OWC reserves the right to refuse to service any iPad if it has sustained liquid damage, excessive physical damage or is otherwise too damaged to repair.

Existing Product Warranties

OWC is not responsible for voiding any warranty or service contract and makes no representation that the services provided hereunder will not violate the terms and conditions of the product's warranty or service contract.

OWC Limited Warranty

OWC warrants (i) that service will be performed in a workmanlike manner and (ii) that all parts or products used in the service will be free from defects in materials and workmanship for ninety (90) days from the Completion Date. This warranty is an express limited warranty. If non-conforming service is provided or a defect arises in a replacement part or product during the ninety (90) day warranty period, at its option, OWC will (1) repair the part or product, using new parts or parts equivalent to new in performance and reliability, (2) exchange the product or a component within the product with a product or component that is new or equivalent to new in performance and reliability and is at least functionally equivalent to the original, or (3) refund the sums paid to it for the service. OWC will cover the cost of shipping in the event there is a defect in workmanship or material.

This warranty also does not apply to: (a) consumable parts, such as batteries; (b) cosmetic damage, including but not limited to scratches and dents; (c) damage caused by accident,abuse, water, or other external causes; (d) damage caused by operating the product outside the permitted or intended uses; (e) damage caused by service performed by anyone who is not an OWC authorized service provider; or (f) any product where the serial number has been removed or defaced. THIS WARRANTY AND REMEDY ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES AND REMEDIES. OWC SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Pre- and Post-Service Damage Checklist

A checklist will be provided that describes the condition of the iPad pre- and post-service. Any new physical damage including, but not limited to, dents or scratches, must be reported at time of delivery. Any rights to object to physical damage not reported within 24 hours of receipt are forfeit.

Deletion of Data

Since an iPad is capable of storing software programs, data and other information, OWC recommends making backup copies of all information and content. A separate backup copy of the contents shuld be made and the unit should be restored to the factory settings. THE PERSONAL CONTENTS OF THE IPAD WILL BE DELETED DURING THE COURSE OF SERVICE AND THE IPAD WILL BE RESTORED TO THE ORIGINAL FACTORY SETTINGS. OWC AND ITS AGENTS ARE NOT RESPONSIBLE FOR ANY DAMAGE TO OR LOSS OF PROGRAMS, DATA OR OTHER INFORMATION CONTAINED ON THE IPAD. Furthermore, OWC is not responsible for any costs of recovering, reprogramming, or reproducing any program or data stored in or used with the product.

Privacy

Prior to submitting a product for diagnosis or repair, any personal data, content, or information on the product ("Personal Content") that should not be viewed by OWC should be removed prior to shipping. While OWC respects customer privacy and does not generally, during the course of completing service or repairs, review the Personal Content stored in customer products, such Personal Content may be viewed inadvertently or purposely at customer request or as needed to complete repairs or service. OWC RESERVES THE RIGHT AT ALL TIMES TO DISCLOSE ANY SUCH PERSONAL CONTENT THAT OWC DEEMS NECESSARY TO COMPLY WITH ANY APPLICABLE LAW, REGULATION, OR GOVERNMENTAL REQUEST.

Limitation of Liability

IF THE IPAD PRODUCT SHOULD BE DAMAGED OR LOST WHILE IN OWC'S CUSTODY, OWC'S LIABILITY IS LIMITED TO THE COST OF REPAIR OR REPLACEMENT OF THE AFFECTED PRODUCT. OTHERWISE, OWC'S ENTIRE LIABILITY FOR DAMAGES ARISING FROM ANY CAUSE WHATSOEVER WITH RESPECT TO THE SERVICE OF THE PRODUCT, WHETHER DUE TO NEGLIGENCE OR ANY OTHER REASON, IS LIMITED TO THE COST OF SERVICES PROVIDED HEREUNDER. OWC HAS NO LIABILITY WHATSOEVER FOR INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, SUCH AS LOST PROFITS OR REVENUE. OWC HAS NO LIABILITY FOR LOSS OF OR DAMAGE TO DATA OR SOFTWARE APPLICATIONS WHILE PERFORMING SERVICE.

General

These Terms, and any dispute arising hereunder, will be governed by Illinois law with personal jurisdiction by and venue in the state/federal courts of McHenry County, Illinois.
