Rules and Regulations
- INTRODUCTION: Other World Computing "Create Your Own Commercial" Competition (the "Competition") is sponsored by Other World Computing ("Sponsor"), 1004 Courtaulds Drive, Woodstock, IL 60098 . The Competition is open to legal residents of the fifty (50) United States and the District of Columbia who have reached the age of majority in their jurisdiction of residence at the time of entry. Employees of Sponsor and its respective affiliates, parents, subsidiaries, and advertising and promotion agencies involved with this Competition, and the immediate family members and/or those living in the same household of each are not eligible to participate. The Competition will run from 10/31/06 at 12:01:00 AM (ET) through 12/31/06 at 11:59:59 PM (ET).
- HOW TO ENTER: Go to www.MacSales.com and follow the registration process including printing of entry form for the Competition. As a condition of entry, you will be required to affirm where indicated to signify that you accept and agree to be bound by these Official Rules. With your entry form you may submit up to three (3) video commercials of your creation that demonstrate your response to mission of positively promoting Other World Computing. Videos submitted must be burned on DVD or CD. Video(es) and entry form must be received no later than 11:59P.M. (CT) on 12/31/06 to qualify for the Competition. You may submit more than one video in accordance with the entry process, but you cannot submit the same video more than once. Entries become the sole property of Sponsor and will not be returned.
Upon submission, all commercials will be reviewed by the Sponsor to determine if the commercial will be posted on the website based on the following criteria:
- Is there any inappropriate content (nudity, foul language, excessive violence)?
- Does the commercial present a positive depiction of the company?
- Does the commercial meet the basic technology requirements?
- Does the commercial hold the viewers interest?
- Is the commercial brand appropriate?
- Would customers of Other World Computing enjoy watching the commercial?
- Does the commercial have appropriate viral "buzz" value?

- Commercials may be posted on the Sponsor’s website, broadcast at Macworld Conference and Expo 2007, posted to third party sites, and/or broadcast, posted, or otherwise used in other marketing and promotional endeavors. Sponsor reserves the right in its sole discretion to select the number, if any, of commercials worthy of broadcast, posting, or other use out of the total number submitted.
- ENTRY REQUIREMENTS/CLEARANCES: ENTRY REQUIREMENTS/CLEARANCES: All videos must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the video contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the video, any and all releases and consents necessary to permit the use and exhibition of the video by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who appears in or is identifiable in the video (collectively, the "Clearances"). If any person appearing or identifiable in the video is under the age of majority in his/her state of residence, the signature of a parent or legal guardian is required on each release. Furthermore, if the film contains a recognizable public place, you must submit a signed Premises Release. All signatures must be original. By submitting a video, entrant warrants and represents that he/she and any persons appearing or identifiable in the video consent to the submission and use of the video in the Competition, to its posting on the Internet in connection with the Competition, and in any subsequent promotion of the Sponsor and/or Competition. The video must not, in the sole and unfettered judgment of the Sponsor, contain any sexually explicit, disparaging, libelous or other inappropriate content or nudity.
- RIGHT TO DISQUALIFY: The Sponsor reserves the right, in its sole and unfettered discretion, to disqualify and remove at any time during the contest any video that potentially or actually infringes any third party's copyright(s). Sponsor reserves the right, in its sole and unfettered discretion, to disqualify and remove any video that it believes contains any sexually explicit, disparaging libelous or inappropriate content, is not suitable for publication, infringes the rights of any third party or otherwise does not meet any other requirements in these Official Rules. Sponsor further reserves the right, in its sole and unfettered discretion, to verify at any time during the Competition that all necessary Clearances have been obtained and to disqualify and remove any video if it believes that the necessary Clearances have not been obtained.
- FINAL JUDGING: The 25 highest scoring Semi-Finalists will be judged by a panel of celebrity judges to select the one Grand Prize winner based on the following criteria: Originality and creativity - 40%; Appropriateness to theme - 30%; and Overall appeal - 30%. In the event of tie, the clip with the highest overall score in Overall appeal will be selected as the Grand Prize winner.

- PRIZES: (1) Grand Prize – An A/V rated Newer Technology miniStack V2 external hard drive storage solution and FireWire+USB port expansion hub; (2) Finalist Prizes – A $50 OWC gift certificate; (5) Semi Finalist Prizes – A NewerTech TRAFFICJamz FM Transmitter for use with Apple iPod devices. Prizes consist of only those items specifically listed as part of the prize. No substitution or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. All federal, state and local taxes on prizes are the sole responsibility of the prize winners.
- GENERAL RULES: The Competition is governed by and subject to the laws of the United States. All federal, state, and local laws and regulations apply. Void where prohibited by law. All prize winners will be notified by mail, email, or telephone at the contact information provided at the Registration Site and must sign and return any applicable documentation deemed necessary by Sponsor, including all required Clearances, an Affidavit of Eligibility and Liability/Publicity Release, within forty-eight hours (48) following attempted notification. Noncompliance within this time period may result in disqualification and an alternate winner may be selected. By entering Competition, entrants give the Sponsor the right to publish, use, adapt, edit and/or modify such video in any way, in any and all media and without consideration to entrant or other identifiable persons depicted in the video and winner irrevocably assigns and transfers all rights, title and interest in the submission to the Sponsor and, if required, will sign any documents necessary to transfer copyright. By entering Competition and/or accepting prize, entrant grants permission to Sponsor and their agencies to use winners' name and/or likeness for purposes of advertising, publicity and promotional purposes, without further compensation to entrant unless prohibited by law. Prizes are non-transferable. By accepting prize, winner agrees to hold Sponsor, their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use/redemption of any prize. Entrants agree to be bound by the Official Rules and the decisions of the judges which are final and binding on all matters relating to this Competition. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prizes.

- Sponsor is not responsible for any electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest. SPONSOR RESERVES THE RIGHT IN ITS SOLE AND UNFETTERED DISCRETION TO DISQUALIFY ANY PERSON WHO TAMPERS OR IS SUSPECTED OF TAMPERING WITH THE ENTRY AND/OR VOTING PROCESS. Caution: Any attempt by an entrant to deliberately damage any website, including but not limited to, the registration site, or undermine the legitimate operation of the COMPETITION is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages and or other relief from any such entrant to the fullest extent of the law.
- WINNER'S LIST: For names of winners, send a separate, stamped, self-addressed envelope to: Competition Winners, Other World Computing, Public Relations Department, 1004 Courtaulds Drive, Woodstock, IL 60098, to be received by February 1st, 2007.
