OWC warrants to the purchaser that the upgrade service components are free from defects in materials and workmanship for a period of up to one (1) year from the date of the upgrade. OWC, at its option, will repair or replace upgrade service component(s) at no cost that are found to be defective within the warranty period. OWC reserves the right to replace with similar components that are equal to or better than the original. Warranty period is the time remaining on the iMac Pro factory warranty as of the date of upgrade, based on the manufacturer's serial number. (Ex. An iMac Pro purchased on 1/1/2018 has factory warranty coverage until 12/31/2018. If this iMac Pro participates in the iMac Pro Upgrade Service on 3/31/2018, the customer will receive 9 months of coverage under the Express Limited Warranty.) Should the upgrade be performed on an iMac Pro with less than 90 days of factory warranty remaining, the upgrade service components will be covered for 90 days. All OWC memory components come with OWC's lifetime limited warranty.
Customers are responsible for the cost of shipping the product(s) related to the warranty claim to OWC. Should OWC determine that a valid warranty claim exists on returned product(s), OWC will cover ground return shipment of the repaired or replaced product(s) to customers located within the 48 contiguous United States. Customers located outside of the 48 contiguous United States will be responsible for return shipping as well.
This ELW is NON-TRANSFERABLE and will only be honored for the original purchaser of the OWC Upgrade Service listed on the original OWC Invoice.
Manufacturer warranties, if any, on components are independent from this ELW coverage. OWC cannot advise you on other possible warranty coverage of the product or its components.
All warranties are void if the upgraded iMac Pro is opened by anyone other than an OWC or Apple Certified Technician. Should an iMac Pro submitted for upgrade be diagnosed with any defects or operational problems, OWC reserves the right to reject that iMac Pro from receiving the Upgrade Service. Customer will still be responsible for diagnosis and shipping fees related to the rejected iMac Pro.
OWC does not warrant that the operation of the product will be uninterrupted or error-free. This ELW does not apply: (a) to damage caused by use with non-OWC products; (b) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (c) to damage caused by operating the product outside the permitted or intended uses described by OWC; (d) to a product or part that has been modified to significantly alter functionality or capability without the written permission of OWC; (e) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship; or (f) if any serial number has been removed or defaced.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE).
TO THE EXTENT PERMITTED BY LAW, THIS ELW AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. OWC SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF OWC CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS ELW AND TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY OWC IN ITS SOLE DISCRETION. No OWC reseller, agent, or employee is authorized to make any modification, extension, or addition to this ELW.
OWC DISCLAIMS AND IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY INCLUDING BUT NOT LIMITED TO LOST DATA SUCH AS COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED OR USED.THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS. OWC DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF THE PROGRAMS OR DATA. TO MAXIMIZE YOUR DATA PROTECTION, OWC RECOMMENDS THAT YOU KEEP A BACKUP COPY OF YOUR DATA.

An OWC Tech Support Representative will help determine whether your product requires service and, if it does, will inform you how OWC will provide it. OWC will provide warranty service on products that are tendered or presented for service during the Warranty Period, as permitted by law. You will be responsible for shipping and handling charges to the OWC facility located in the United States of America for any warranty service. This service and its corresponding warranty are not available for international customers. In accordance with applicable law, OWC may require that you furnish proof of purchase details and/or comply with registration requirements before receiving warranty service.
